1. Acceptance of Terms

By using FitMyCV.io and purchasing credits, you unconditionally accept these Terms of Sale.

If you do not accept these terms, please do not use our paid services.

Use of FitMyCV.io is restricted to individuals aged 16 and over.

2. Description of Services

FitMyCV.io is a resume creation and optimization platform powered by artificial intelligence.

2.1. Free Services

• Unlimited manual resume creation
• Unlimited resume editing
• Resume storage in your personal workspace

2.2. Services Consuming Credits

• PDF and DOCX export
• AI-powered resume generation and tailoring
• Resume import and extraction from PDF
• Automatic resume translation
• Resume optimization for job postings
• Resume/job posting match score

2.3. Credit System

When you create your account, you receive a default number of credits allowing you to test the platform's features.

Each feature consumes a variable number of credits according to a defined rate schedule. The credit cost of each feature is displayed before use.

Credits do not expire and remain valid as long as your account is active.

When your credits run out, you can purchase more from the Credit Management page.

3. Pricing and Payments

All prices are displayed in euros (EUR). The publisher is exempt from VAT pursuant to Article 293 B of the French General Tax Code (Code Général des Impôts).

Payments are secured by Stripe and accept credit cards, Apple Pay, Google Pay, and other payment methods depending on your location.

4. Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the User acknowledges and agrees that the provision of Services begins immediately upon order confirmation.

Consequently, the User expressly waives their right of withdrawal for any credit purchase.

5. Refund Policy

All credit purchases are final once the service has been used (resume generation, export, translation, etc.). By making a purchase, you acknowledge having read and accepted this clause.

In case of a technical issue preventing the use of the service, contact our support at [email protected]. We will review your situation on a case-by-case basis.

6. Chargebacks and Payment Disputes

In the event of a chargeback (payment dispute filed with your bank) after using the service:

• The amount of disputed credits will be deducted from your balance, which may become negative.
• You will need to top up your account to continue using credit-based services.

7. Artificial Intelligence

FitMyCV.io acts as a "deployer" of an artificial intelligence system within the meaning of European Regulation 2024/1689 (AI Act).

7.1. Features Using AI

• Resume generation and tailoring
• Resume optimization
• Job posting extraction
• Match score calculation
• Resume translation
• Resume import and extraction from PDF

7.2. Nature of Results

Results generated by AI are suggestions and do not constitute binding recommendations in any way. The user retains full control over the final content of their resumes.

7.3. AI Provider

AI features are provided by OpenAI (United States). Data transmitted to OpenAI is not used to train their models in accordance with their API policy.

8. Intellectual Property

Resumes you create via FitMyCV.io belong to you. You retain all rights to the content you provide.

The interface, source code, algorithms, and all elements of FitMyCV.io are the exclusive property of the publisher and are protected by copyright law.

9. Limitation of Liability

Services are provided "as is", without warranty of any kind, express or implied.

FitMyCV.io does not guarantee:

• Continuous and uninterrupted service availability
• The absence of technical errors or bugs
• Compatibility of generated resumes with all ATS (Applicant Tracking Systems)
• Obtaining an interview or employment as a result of using the service
• The accuracy or relevance of AI-generated content

Maintenance operations may be performed without prior notice, resulting in temporary service interruptions.

Our liability is limited to the amount you have paid for the service during the past 12 months.

10. Prohibited Conduct

The following are strictly prohibited:

• Resale or redistribution of services
• Any attempt to intrude into systems
• Identity theft
• Automated data extraction (scraping)
• Use of bots or automated scripts
• Any use contrary to public decency or public order
• Creation of illegal, defamatory content or content infringing on the rights of third parties

11. Termination and Account Deletion

You can delete your account at any time from your personal settings or by contacting us at [email protected].

Account deletion results in the permanent deletion of all your data (resumes, job postings, history) in accordance with our Privacy Policy.

12. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be published on this page with the update date. Continued use of the service after modification constitutes acceptance of the new terms.

13. Consumer Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of a dispute, the User may resort to a consumer mediator free of charge.

14. Applicable Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, and after an attempt at amicable resolution, the courts of Paris shall have exclusive jurisdiction.
